Race with the Titans powered by Stepathlon - Terms and Conditions
1. The Contest
a. These terms and conditions (“Terms”) are with reference to your participation in the Race with the Titans (“Virtual Event”). The Event is being organized by Irelia Sports India Private Limited (“ISIPL”), the owner and operator of the Gujarat Titans professional twenty20 cricket team (“Gujarat Titans”/“GT”) & Stepthlon Lifestyle Pvt. Ltd. (“SLPL”). You stand a chance to win the prize once you register on Race with the Titans on the Titans FAM app.
b. For the purpose of these Terms, “you” and “your” shall mean any individual who wishes to participate in Race with the Titans. By submitting your step entries (as defined herein), you unconditionally and unequivocally accept these Terms.
2. Submission Guidelines
a. Any person above 14 years of age and residing in India may enter the Event on their own behalf only. Where any person between the age of 14-18 years seeks to participate, such participant shall require the consent of his/her parent/legal guardian and on the submission of an Entry, such consent shall be deemed to have been obtained by the participant from his/her parent/legal guardian.
b. No participation by proxy will be allowed.
c. Each participant is to submit their steps on Race with the Titans on the Titans FAM app. Each step entry will be verified and approved solely by SLPL.
d. Step entries are to be submitted through ‘Log Activity For Today’ & ‘Log Missed Days’ section on Race with the Titans section on the Titans FAM app. For undertaking such submission, participants will be required to register with GT by providing their name, email address and residential address.
3. Eligible Step Entries
a. Step entries must be authentic, and wrong entries of any kind shall be deemed ‘unfit’ by SLPL.
b. The Entries must not (i) infringe the intellectual property rights (or any other rights) of any third party; (ii) in any manner be abusive, obscene, defamatory, harassing, vulgar, indecent, libelous, racist, hateful, or threatening; and (iii) must not be in violation of applicable law. ISIPL & SLPL reserves the right in its absolute discretion to disqualify any submission if it believes that the submission is in violation of the foregoing.
4. Judging Parameter
Entries will be judged on the authenticity and consistency merit by a judge/panel of judges designated by SLPL. The judge(s)’ decisions are final and binding with respect to all Entries, and no correspondence will be entered into concerning their decisions.
5. Opening and Closing Date
a. The opening date for the step-based challenge (Main Race) shall be 31st March 2023 (12:00 IST) and the closing date for the challenge shall be 28th May 2023 (23:59 IST).
b. Entries will be accepted for the period upto 28th May 2023 and for users registered before 28th May 2023. You can use the ‘Log Missed Days’ section to upload steps for the days you missed uploading your steps.
c. SLPL shall not accept any responsibility whatsoever for any technical failure or malfunction or any other issues which may result in any Entry not being properly registered or received.
6. Prize
a. There will be two (2) Ather bike winners in Race with the Titans and the winners will be announced on the Gujarat Titans’ social media handles.
b. SLPL will also notify the participant adjudged as the winner, over the email address provided by the participant while submitting his/her Entry. The winner will be required to complete such steps as reasonably required by SLPL to validate his/her victory and award the Prize (as defined below) such as the furnishing of the delivery address for the delivery of the Prize.
c. The prize for the winning Entries (“Prize”) will be an Ather Energy Private Limited (“Ather”) branded electric scooter, Ather 450X (“Vehicle”). The Participant acknowledges and agrees that the responsibility for the delivery of the Vehicle rests with Ather and is subject to the terms and conditions prescribed by Ather,also available at https://bit.ly/3NWGl3J
d. The timeline for the delivery of the Prize will be communicated to the winner by SLPL post the announcement of the winner. Participants acknowledge and agree that no undertaking or guarantee is afforded by SLPL on the timelines for the delivery of the Prize.
e. SLPL reserves the right to substitute any prize with another without providing any notice.
f. The Participants adjudged as the winner will be required to submit a video testimonial (“Testimonial”), as requested by SLPL, at no additional cost or charge to SLPL.
7. Legal
a. Intellectual Property/Third Party Rights: You must be the sole author and owner of the copyright for your Entry. The submitted Entry must be original, and created by you. The Entry must not be, and must not contain any materials, owned or controlled by a third party for which you have not obtained a license, must not infringe the copyright, trademark, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, or any applicable laws, rules or regulations, or terms of employment, terms of access, etc., which apply to you. By entering Race with the Titans, you hereby grant to ISIPL & SLPL a non-exclusive, perpetual, worldwide, irrevocable, royalty-free license to reproduce, distribute, publicly display, and otherwise exploit the Entry, including specifically for commercial purposes.
b. Indemnification: You hereby agree to indemnify, defend and hold harmless ISIPL & SLPL from and against all liability and costs incurred in connection with any claims arising out of or relating to your participation in Race with the Titans, including but not limited to any breach of obligations, representations or warranties in these Terms, or any claim arising out of any breach of a third party’s rights of any nature by you.
c. Waiver: The Entry is entered in Race with the Titans at your own risk and strictly in accordance with these Terms. ISIPL & SLPL bear no responsibility for any loss or damage incurred as a result of your participation in Race with the Titans, and you waive any claims against ISIPL & SLPL in relation thereto.
d. Breach of Terms: Any breach of the Terms will automatically void your Entry. If a breach of any of the Terms set forth herein is discovered after the award of the Prize, then ISIPL & SLPL has the right to require the return of such Prize awarded to you, and you agree to return such Prize. Any depreciation in the value of the Prize will be required to be made good by you on demand.
e. Disclaimer: You acknowledge and agree that:
(i) ISIPL & SLPL shall neither be liable nor responsible for any actions or inactions of Ather or any other third party and hereby expressly disclaims any and all responsibility and liability in that regard;
(ii) The responsibility for any claims arising out of or relating to the Vehicle, including without limitation, the failure of Ather to deliver the Vehicle, shall rest solely with Ather and no claims shall lie against ISIPL & SLPL;
(iii) By Participating in Race with the Titans you agree to share your information with Stepathlon who will use it as per their Terms
Conditions and Privacy policy and Other Terms and Conditions.
(iv) All expenses incurred by the winner for exploiting/in the course of exploiting the Prize, will be the sole liability of the winner and no claim shall lie against ISIPL or SLPL (Eg. RTO charges, insurance charges, road tax, local taxes, maintenance charges etc. in respect of the Vehicle shall be borne by the winner).
f. Promotional Communication: You hereby agree to receive promotional and marketing communication including but not limited to email communication/newsletters, WhatsApp messages, mobile SMS, call etc. from ISIPL & SLPL from time to time. You further expressly waive Do Not Call (DNC)/ Do Not Disturb (DND) registrations on your phone/mobile numbers for contacting you for such promotional/marketing purposes.
8. General
ISIPL & SLPL reserves, at its discretion, the right to: (i) vary these Terms without notice, including but not limited to the opening and closing times for submission of Entries; (ii) withdraw, vary or substitute the prize associated with Race with the Titans; (iii) disqualify any entrant who breaches these Terms or has acted fraudulently; or (iv) cancel the Contest at any stage.
9. Governing Law and Jurisdiction
The Contest shall be governed by and construed in accordance with Indian laws. Any disputes arising out of or in connection with the Contest and/or your Entry will be subject to the exclusive jurisdiction of the courts of Ahmedabad, India.
